1.2 Information collected through our store
In Short: We may collect information regarding your geo-location, mobile device, push notifications, when you use our store.
If you use our store, we may also collect the following information: 1) Geo-Location Information. We may request access or permission to provide location-based services. 2) Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device’s SMS messages, and other features. 3) Push Notifications. We may request to send you push notifications regarding service-related or marketing messages . If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.
All such data processing is based on your consent (Art. 6(1)(a) GDPR) and can be withdrawn at any time.
1.3 Information collected from other sources
In Short: We may collect limited data from public databases, marketing partners, social media platforms, and other outside sources.
We may obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms and partners (such as Facebook), as well as from other third parties in compliance with GDPR. Examples of the information we receive from other sources include: social media profile information (your name, gender, birthday, email, current city, state and country, user identification numbers for your contacts, profile picture URL and any other information that you choose to make public); marketing leads and search results and links, including paid listings (such as sponsored links).
The types of data received may include your name, contact details, profile photo, city or country of residence, and marketing preferences, depending on what you have made publicly available or consented to share.
We process this data only where we have a valid legal basis, including, your consent (Art. 6(1)(a) GDPR), for example when you authorize a social media platform to share your data with us; performance of a contract (Art. 6(1)(b) GDPR), if the information is needed to fulfil an order or service or our legitimate interests (Art. 6(1)(f) GDPR), such as improving our services or marketing activities, provided these interests are not overridden by your fundamental rights and freedoms
2. HOW DO WE USE YOUR INFORMATION?
In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.
We use the personal data we collect for the following purposes and on the following legal bases:
To facilitate account creation and logon process. If you choose to link your account with us to a third party account *(such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process. The legal basis is Art. 6(1)(a) or Performance of a contract (Art. 6(1)(b)).
To send you marketing and promotional communications. We and/or our third party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can withdraw your consent at any time.
The legal basis is Art. 6(1)(a).
Fulfill and manage your orders. We may use your information to fulfill and manage your orders, payments, returns, and exchanges made through the store. Deliver targeted advertising to you. We may use your information to develop and display content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness. The legal basis is Art. 6(1)(a) or the legitimate interests (Art. 6(1)(f)).
Request Feedback. We may use your information to request feedback and to contact you about your use of our store. The legal basis is Art. 6(1)(a).
To enable user-to-user communications. We may use your information in order to enable user-to-user communications with each user's consent. The legal basis is Art. 6(1)(a).
For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our store, products, services, marketing and your experience. The legal basis is the legitimate interests (Art. 6(1)(f)).
We do not use your personal data for automated decision-making that produces legal effects or similarly significant consequences without your explicit consent or as otherwise permitted by law.
3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

Legal Obligations (Art. 6(1)(c) GDPR): We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
Vital Interests (Art. 6(1)(d) GDPR): We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
More specifically, we may need to process your data or share your personal information with the following categories of recipients:
Third-Party Advertisers. We may use third-party advertising companies to serve ads when you visit the store. These companies may use information about your visits to our Website(s) and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you. Such processing only occurs with your consent via our cookie banner.

Third-Party Payment processor. We may use third-party processor companies to serve payment when you visit the store. These companies may use information about your visits to our Website(s) in order to provide payment service and verify your payment as well as to prevent fraud.
IT and Hosting Service Providers: We use external service providers for web hosting, cloud storage, and IT support under data processing agreements compliant with Art. 28 GDPR. Our online shop platform is operated using the services of Shopify International Ltd., 2nd Floor, 1–2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland (“Shopify”). In connection with operating our online shop, your order data (including personal data) is processed by Shopify and stored on servers located in the United States. Shopify acts as our data processor under Art. 28 GDPR, and the transfer of personal data to the United States is safeguarded by the European Commission’s Standard Contractual Clauses (SCCs) pursuant to Art. 46 GDPR.

Public Authorities: If required by law, we may disclose personal data to regulatory or law enforcement bodies.
Other Users. When you share personal information or otherwise interact with public areas of the store, such personal information may be viewed by all users and may be publicly distributed outside the store in perpetuity. If you interact with other users of our store and register through a social network (such as Facebook), your contacts on the social network will see your name, profile photo, and descriptions of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our store, and view your profile.
Transfers to Third Countries: If we transfer your personal data outside the European Economic Area (EEA) to a third country or international organization, this may include in particular:
- the transfer of order data to Shopify in the United States for the operation of our online shop platform, and remote access to and processing of order data by employees of our corporate group located in Mainland China and Hong Kong.
Such transfers are carried out in compliance with Articles 13(1)(f), 45, and 46 of the GDPR. In the absence of an adequacy decision by the European Commission under Article 45 GDPR, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses (SCCs) or other legally recognized mechanisms under Article 46 GDPR. These safeguards ensure that your personal data is afforded a level of protection essentially equivalent to that in the EU.

Analytics and Marketing Tools
We use various third-party analytics and marketing tools that set cookies or similar technologies to analyze website usage, measure the effectiveness of our marketing campaigns, and deliver personalized advertising. These services process personal data (such as IP address, device identifiers, browsing behavior) based on your consent (Art. 6(1)(a) GDPR), which you can provide via our cookie banner and withdraw at any time through our Cookie Settings tool.

These providers may store data on servers in third countries (e.g., USA). Where such transfers occur, they are based on the European Commission’s Standard Contractual Clauses (SCCs) or other legally recognized safeguards under Art. 46 GDPR.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

5. HOW DO WE HANDLE YOUR SOCIAL LOGINS?
In Short: If you choose to register or log in to our websites using a social media account, we may process only the information necessary for authentication and account set up.
Our store offers you the ability to register and login using your third party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. 6. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

The store may contain advertisements from third parties that are not affiliated with us and which may link to other websites, online services or mobile applications.
We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this privacy policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services or applications that may be linked to or from the store. You should review the policies of such third parties and contact them directly to respond to your questions.
7. HOW LONG DO WE RETAIN YOUR INFORMATION?
In Short: We retain your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.
We will only retain your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements).
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

8.HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate technical and organizational security measures designed to protect the incidental or unlawful destruction, loss, alteration, unauthorized disclosure or access of any personal information we process. These measures include, but are not limited to: secure servers or encrypted communications, access controls and authentication procedures, regular security assessments and updates, data minimization and pseudonymization where appropriate. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our store is at your own risk.
You should only access the services within a secure environment.
9. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to children under 16 years of age in accordance with Art. 8 GDPR.
We do not knowingly solicit data from or market to children under 16 years of age. By using the store, you represent that you are at least 16 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the store. If we learn that personal information from users less than 16 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. You can review, change, or terminate your account at any time. If you would at any time like to review or change the information in your account or terminate your account, you can:
- Log into your account settings and update your user account. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.
- Opting in email marketing: By registering for a Creality account, you are automatically subscribed to receive emails from Creality Store. We only send marketing communications based on your explicit consent (Art. 6(1)(a) GDPR). If you no longer wish to receive emails from us, you can unsubscribe at any time by clicking the unsubscribe link in our emails.
- Opting out of email marketing: You can withdraw your consent and unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, even if you opt out of marketing emails, we may still need to send you service-related emails that are necessary for the performance of our contract with you (Art. 6(1)(b) GDPR).

11. CONTROLS FOR DO-NOT-TRACK FEATURES?
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. 13. DO WE MAKE UPDATES TO THIS POLICY?
In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws and to reflect changes in our processing activities.

14. MOBILE TERMS OF SERVICE
The creality mobile message service (the "Service") is operated by Creality (“creality”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By subscribing to creality’s SMS/text messaging service, we process your mobile number with your consent and in compliance with applicable data protection laws.
By opting in, you agree to receive recurring SMS/text messages from and on behalf of creality through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, sales, coupons, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with creality. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time by texting the single keyword command STOP to creality or clicking the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other creality mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We maintain records of your consent to receive SMS marketing in accordance with Art. 7 GDPR.
We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
